THE RIGHT IN THE FOOD CRISIS OF THE EPIDEMIC OF OVERWEIGHT AND OBESITY

Abstract


The problem of overweight and obesity as an epidemiological phenomenon have been absent from legal approaches. This paper studies the role of the Law in the face of this epidemic. In this sense, the concept of food is examined in order to determine the nature of ultra-processed products and their legal implications. Likewise, the role of the industry and its influence on the design of public policies are analyzed. Finally it propouses the concept of "Food Health" as the principal subject of an incipient Food Law yet to crystallize, whose principles are called to regulate the complex social relationships that derive from the food facts.
