Abstract

This paper aims to analyze the exclusion of trans women from the possibility of being considered passive subjects of the feminicide crime. It uses a hypothetical-deductive analysis and a bibliographic review to discuss the possibilities of using contemporary meanings of gender in the broadest sense of the present criminal rule. In the first section, it exposes the mistaken and anachronistic notion of synonymy between biological sex and gender, and the harmful simplification that results from these notions. In a second section, it discusses the social, political and cultural context of patriarchy as a discursive locus of power that contributes to the establishment of the normative standard on gender. In its third and final section, it shows examples of the current state of Brazil’s jurisprudence and hegemonic doctrine on the subject, showing the difficulties of rupture and discussion caused by the panorama previously exposed, concluding that the application of feminicide should include trans women, since it is intended to overcome the existing structural imbalance, in the same way as it is necessary to, minimally, respond to the precariousness to which they are exposed.
