Abstract

This article explores the judgment of repetitive claims in the Brazilian civil procedural system from the perspective of Ronald Dworkin's theory of law's integrity, addressing the implications of this theory in the Incident of Resolution of Repetitive Claims (IRDR) and in Repetitive Special and Extraordinary Appeals. It is demonstrated that the judgment of repetitive claims, based on the techniques provided in the 2015 Code of Civil Procedure, can contribute to the formation of stable jurisprudence, which is essential for legal certainty, thus necessitating the consideration of the concept of law's integrity. The article concludes that the concept of integrity requires coherence and unity within the legal system, so the analysis of repetitive issues must be conducted through an understanding of law as integrity, not only resolving the disputed issue but also leading to the most appropriate decision for the specific case. For this study, bibliographic research and the deductive method are employed, starting from a macro perspective to a micro-analytical conception of the topic under study, and finally, as a technical procedure, thematic, theoretical, and interpretative analysis is conducted, seeking suggestions for resolving the highlighted issue.
