Abstract

Abstract: The scope of this article is to critically analyze the use of electronic ankle bracelets in the Brazilian penal system, as an instrument for monitoring individuals serving alternative sentences. Initially, the social stigmatization that affects users of these devices is discussed, highlighting the social impacts and barriers to the reintegration of those monitored. Next, the challenges inherent to implementing these technologies are addressed, highlighting operational flaws, high costs and gaps in the regulatory framework that govern their use. The investigation is based on a comprehensive bibliographical review, complemented by analyzes of emblematic cases that illustrate positive and negative aspects of the use of electronic devices, in the criminal and social context. It is concluded that, although these tools represent an important innovation in mitigating prison overcrowding and promoting alternative sentences, there are sensitive consequences, in the relativization of the human dignity of those monitored, in addition to an effectiveness limited by the stigmatizing burden and practical obstacles to your application. The article therefore proposes the improvement of these technologies and their integration with other social reintegration strategies as imperative for fulfilling the declared functions of electronic monitoring services in the country.
