HUMAN RIGHT TO HEALTH AND GENDER: THE MENTAL HEALTH OF MIGRANT WOMEN IN THE CONTEXT OF CLIMATE CRISES UNDER THE BIOPOLICY PERSPECTIVE OF FRATERNAL RIGHT

Abstract

The theme of this research focuses on the human right to mental health of migrant women. The general objective is to analyze the mental health of migrant women who are climate refugees in the context of climate crises. The specific objectives are: 1) Address the institute of climate refuge and its repercussions in the field of Human Rights; 2) Analyze the mental health of migrant women in the context of climate crises. The investigation is articulated, at the methodological level, by the hypothetical-deductive method and guided by a bibliographic and documentary analysis. The theoretical basis chosen for the development of the discussion is the Theory of Fraternal Law, with a biopolitical matrix, designed by the Italian jurist Eligio Resta. Given the intersection between the human right to health and the gender element, the question arises: can the mental health of migrant women in the context of climate crises be analyzed from the perspective of Fraternal Law? It is clear that numerous pathological processes cross the bodies of migrant women, this fact causes a traumatic existential horizon that has repercussions on the mental health of these women. Under the aegis of climate crises, fraternity presents itself as a biopolitical mechanism for transforming the real world.
