SOBRE O PAPEL DO DIREITO NO PLANEJAMENTO E CONTROLE DE POLÍTICAS PÚBLICAS – REFLEXÕES SOBRE AS INTERAÇÕES ENTRE O "INSTITUTIONAL ANALYSIS AND DEVELOPMENT FRAMEWORK" E O DIREITO
Resumo
Partindo do estado da arte da “policy analysis”, i.e., da investigação do funcionamento de arranjos institucionais complexos feita pela ciência política, o artigo delineia o escopo de um autêntico esforço jurídico interdisciplinar voltado para a compreensão e manejo das políticas públicas. Trata-se de aproximar análises que, apesar de independentes entre si, e de partirem de pressupostos aparentemente muito distintos, apresentam pontos de contato notáveis, que possibilitam aperfeiçoamentos significativos para uma “tecnologia jurídica governamental” da democracia. Em particular, cuida-se de demonstrar as vantagens da incorporação da Institutional Analysis and Devclopment Framework, de Elinor Ostrom, a uma abordagem jurídica das políticas públicas, e de apontar potencialidades estimulantes de sua combinação com outras matrizes teóricas.
